Alina Habba steps down after court deems ineligible her appointment.
The former personal attorney for Donald Trump has stepped down as the US Attorney for New Jersey. This follows a court battle that invalidated her eligibility to occupy the role.
Official Departure
US Attorney General, Pam Bondi, confirmed the prosecutor's departure on the start of the week. Bondi stated that the judicial decision made it impossible for the official to lead the department effectively.
"But do not mistake adherence to the ruling as defeat," Habba stated. "The effort will now extend throughout America."
Judicial Challenge
The departure follows closely on a US appeals court found that she had been unlawfully serving as the federal prosecutor. This judgment is expected to impact scores of criminal cases in the Garden State.
The appellate judges said that a interim role that skirted confirmation by the US Senate breached the federal law governing appointments.
Future Role and Reaction
Bondi said that the former prosecutor will continue working within the DOJ as a top consultant. Habba plans to seek further review of the court's action, with hopes of a overturned decision.
On a social media platform, she contended that judges "cannot be permitted to countermand the executive's selection of attorneys responsible for executing the fundamental role of the presidency of prosecuting crime."
Performance in Office
She praised the prosecutor's work and said that during her run, the city of Newark saw a 20% reduction in crime. She also stated that the southern city of Camden experienced its first summer in half a century free from homicides.
Connection to Donald Trump
Habba, originally became part of the former president's legal defense in 2021. Subsequently, she acted for her client in his hush-money trial in New York last year, which resulted in his guilty verdict on dozens of charges of financial record manipulation.
Before her appointment to the role of US Attorney, Trump had announced he was naming her as his senior adviser in a potential future term, describing the lawyer as a steadfast ally and a "tireless advocate for justice".
